APPEAL FROM THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF MASSACHUSETTS

[Hon. William G. Young, U.S. District Judge]

John McCambridge appeals pro se from the denial of his petition for a writ of habeas corpus by the district court. He claims that his conviction in the Massachusetts state court for manslaughter is in violation of his constitutional rights because the prosecution failed to disclose exculpatory evidence and then used the absence of that evidence to impeach his credibility during closing argument. In determining whether McCambridge is entitled to a writ of habeas corpus pursuant to 28 U.S.C. 2254(d)(1), *fn1 we examine the opinion of the Massachusetts Appeals Court affirming his conviction. We conclude that the Appeals Court reached a decision that was both contrary to and an unreasonable application of clearly established federal law. Accordingly, we reverse the judgment of the district court.
