On Report and Recommendation of the Board on Professional Responsibility

Submitted November 15, 2001

Respondent Glenn M. Rocca was disbarred by the Supreme Court of New Jersey on May 12, 2000, for engaging in conduct involving fraud, deceit, dishonesty, and misrepresentation. The facts underlying his disbarrment, as well as the discipline of his legal partners, are set forth in the opinion of the Supreme Court of New Jersey, In re Pena, 753 A.2d 633 (N.J. 2000). In short, respondent entered into an agreement to become part owner of a liquor license and bar business with someone who was statutorily prohibited from owning a bar or becoming a liquor licensee. Respondent executed a sham purchase contract to conceal the interests of the co-owner. The sham contract was, thus, part of a conspiracy to evade the law. In furtherance of the scheme, respondent lied to and misled authorities investigating the transaction.
