Former Microsoft Corp. senior manager Brian Jorgenson was sentenced to two years in prison and three years of supervised release for insider trading from which he and his partner profited $400,000, U.S. Attorney Jenny Durkan of the Western District of Washington announced Friday.

In his scheme, Jorgenson and his co-defendant Sean Stokke, profited from using non-public information related to Microsoft’s planned investment in Barnes and Noble in 2012, the software company’s failure to reach its earnings projections in the fourth quarter of the fiscal year 2013, and the company’s rise in first quarter earnings in fiscal 2014, the United States Department of Justice’s statement said. As a manager in the company’s corporate finance and investment division, Jorgenson was privy to such information before it was made public.
