Faced with endless hours of mind-numbing document review, at least a few contract attorneys have thought, “You know, I should get overtime for this.” So far, courts are split on the issue.

In September U.S. District Judge Richard Sullivan in the Southern District of New York dismissed a putative class action against Skadden, Arps, Slate, Meagher & Flom and Tower Legal Staffing seeking overtime pay for contract attorneys. But an almost identical case against Quinn Emanuel Urquhart & Sullivan and legal staffing company Providus New York, brought by the same lawyer, D. Maimon Kirschenbaum of Joseph & Kirschenbaum, has survived a motion to dismiss.
