Our latest roundup of litigation in which Am Law 200 firms are either defendants or plaintiffs includes a third attempt by a group of plaintiffs to bring suit against O’Melveny & Myers and litigation partner Jeffrey Kohn for their involvement representing Poly Prep Country Day School in a high-profile sex abuse scandal.

In a motion on Thursday for permission to appeal, 11 of the 12 Poly Prep alumni who received a settlement after accusing the elite Brooklyn prep school of covering up years of sexual abuse allege that the school’s lawyers at O’Melveny prolonged litigation in the case. The plaintiffs claim that O’Melveny and Kohn made intentional misrepresentations to a federal court, including information regarding the time frame in which the school became aware of the accusations of abuse, according to the plaintiffs’ attorney, solo practitioner Kevin Mulhearn.
