The very term “alternative” fee arrangement suggests that hourly billing is the natural default position. But it hasn’t always been that way.
“Hourly billing is a lot more recent a phenomenon than people realize,” says John Toothman, president of Devil’s Advocate, a legal fee management consulting firm. “People talk about hourly billing being replaced, but hourly billing is in itself a replacement.”
