Competing Paths Forward for Wine, Liquor Privatization

Working into the early morning hours of June 30 in an effort to meet Governor Tom Corbett's demands to pass legislation for the 2013-14 state budget, the Pennsylvania Senate in a 27-23 vote passed its vision for the privatization of the state's wine and liquor operations. High Court Decision on Contract Renewals Favors Franchisors

In a significant victory for franchisors, a unanimous U.S. Supreme Court recently held in Mac's Shell Service Inc. v. Shell Oil Products Co. that franchisees who were not compelled to abandon their franchise and signed and continued to operate under renewal agreements cannot sue under the Petroleum Marketing Practice Act, 15 U.S.C. §§ 2801, et seq., or PMPA, for constructive termination and constructive non-renewal.

Bill Entangles Pa. in Liquor Makers' Relationships With Wholesalers
