Summary Judgment: Has the Tide Turned?No longer is the court requiring plaintiffs to try and fit a square peg into a round hole by ignoring circumstantial evidence of discrimination while requiring a plaintiff to present increasing amounts of evidence to fit the McDonnell-Douglas paradigm. Instead, the court is now treating circumstantial evidence as it should—where there is smoke, a jury should decide whether there is fire.
