Product-By-Process Patent Claims: Contrasting United States and Europe

Christopher A. Hughes, a partner at Cadwalader, Wickersham & Taft, and Bert Oosting, a partner at Lovells in Amsterdam, the Netherlands, write that in Europe, while product-by-process claims are permissible for a new and inventive product (regardless of the process of making it), patentability is much more restricted than in the U.S. ? i.e., requiring a showing that the product can only be described by way of the process.
