Strong Cybersecurity May Save Your Business Big BucksLikely in an effort to curtail some of the financial fallout businesses suffer from cyberattacks, the Florida legislature passed House Bill 473 (HB 473). HB 473 would create a new Florida statute, 768.401, F.S., that would limit the liability of a business ("covered entities" or "third-party agents") for "cybersecurity incidents" so long as the business: adopts a cybersecurity program that substantially aligns with certain standards and guidelines articulated in the statute; and substantially complies with the notice provisions of the Florida Information Protection Act.

This new law provides highly sought-after reforms to Florida's Telephone Solicitation Act (FTSA). After coming into effect on July 1, 2021, the FTSA yielded an immediate wave of frivolous class action lawsuits against all types of business communicating to Florida residents about their products and services.
