***This is a non-CLE seminar*** To better understand the shifting nature of these responsibilities, Corporate Counsel has conducted an exclusive survey with senior in-house counsels and legal leaders to gauge how their relationship with the board has changed over the last year. Our research also asked what role these senior in-house counsels now play in driving business results within their organization as well as how compliance, data privacy, cybersecurity and other issues now play into the decision-making process.

The alarming statistics are being felt nationwide. The disproportionate fallout of Covid-19 continues to force women out of the workforce, away from promotions, and further down the pipeline for senior leadership positions. This timely session will examine what we can do to change the course of this devastating trend, how we can support our fellow female lawyers in the workplace, and what it will take to overcome this roadblock on the road to gender equity.

As the courts reopen and in-house counsel reevaluate their caseloads, we will take a look at what legal departments have been experiencing on the litigation front in terms of “old” as well as newly-brought cases.

This panel also will cover topics ranging from access to courts, to the increased use of inherent judicial power, to virtual trials, to valuation and compromise in uncertain (unprecedented) times, to recent developments in avoidance actions.

While COVID-19 has led to a substantial increase in the number of bankruptcy filings, its impact on valuation issues in the context of chapter 11 cases is less clear. Employing their differing perspectives, the panelists will explore how the uncertainty created by COVID-19 has affected the analysis of issues like plan feasibility, cost of capital, the pricing of risk, and the application of valuation methodologies in chapter 11 proceedings, with a particular emphasis on retail cases.

It's no secret that large-chain entertainment companies such as theaters and theme parks have been suffering through the pandemic. This panel will discuss restructuring options, hurdles and prospects for a broad array of these entities. The panelists will also discuss and debate the dynamics related to the fact that company projections and capital markets have priced in substantial recoveries for these entities in the second half of 2021.

This session will explore current trends in distressed real estate, along with strategies for secured creditors, borrowers and investors as they continue to weather the pandemic, the legal implications of recent legislation and case law, and more.
