“It's unclear to me whether there's a direct link with Kiobel,” says Judith Archer, a partner at Fulbright & Jaworski. “But I think the case may well have been a factor.”

The claimants are the families of children whose cases of meningitis were treated with Trovan, an experimental Pfizer drug, without parental consent. The treatment led to 11 deaths and numerous injuries. In 2009, Pfizer settled a suit with the Kano state government in Nigeria, creating a trust fund to compensate victims.
