The National Labor Relations Board (NLRB) has extended its deadline for employers to display employee rights notices yet again—this time to April 30.

In August 2011, the NLRB issued its final rule requiring most private employers to post an 11-inch by 17-inch “Notification of Employee Rights Under the National Labor Relations Act.” The purpose of the notice is to inform employees of their rights under the Act and explains to employees how to file unfair labor claims against their employer.

“The National Labor Relations Board has agreed to postpone the effective date of its employee rights notice-posting rule at the request of the federal court in Washington, DC hearing a legal challenge regarding the rule,” the board said in a Dec. 23, 2011, statement. “The Board's ruling states that it has determined that postponing the effective date of the rule would facilitate the resolution of the legal challenges that have been filed with respect to the rule.”

The NLRB said initially that the deadline for posting the rule notification was Nov. 9, 2011, then in October delayed the deadline to Jan. 31.

Regardless of the deadline, experts say employers should familiarize themselves with the rule. “I strongly recommend that employers review the Final Rule to determine whether they are covered by it and, if so, obtain appropriate legal advice regarding compliance,” Fisher & Phillips Partner George Adams told InsideCounsel in October.
