Nearly six months into the year, the U.S. Department of Justice under President Donald Trump has taken its first public action involving a foreign bribery case. It was a declination to prosecute Linde North America Inc. and Linde Gas North America.

New Jersey-based Linde agreed to disgorge and forfeit about $11.2 million in profits, but faces no other penalty for its Foreign Corrupt Practices Act violation.

Amy Ficon, head of external communications at Linde, said Linde voluntarily self-disclosed its conduct to the DOJ and cooperated fully throughout the investigation. “Linde remains committed to 100 percent legal compliance and ethical engagement in all business practices,” Ficon added.
