Its commercials pepper daytime television and its billboards can be seen on highways in the Philadelphia area, but the personal injury firm of Morgan & Morgan has now attracted some unwanted attention.

The Philadelphia law firm of Rosenbaum & Associates has sued Orlando-based Morgan & Morgan and its principals in federal court, claiming the firm falsely advertises that it represents clients in Philadelphia and the surrounding area, when it only has one attorney in Pennsylvania with “little or no experience in handling personal injury matters,” according to the complaint.

“Defendants' advertising campaign did, and continues to, mislead the consumer that they actively litigate claims in Pennsylvania when in fact their representation of personal injury claims is nonexistent or minimal,” Rosenbaum's complaint said.

Morgan & Morgan founder John Morgan did not return a call seeking comment Tuesday. The firm has not yet responded in court filings.

Rosenbaum, which also has an active advertising presence with commercials and billboards, claimed in its complaint that the Morgan firm's advertisements lead potential clients to believe that John Morgan would be personally involved in their cases.

The complaint alleged Morgan & Morgan's ads claim that the firm is “not a referral service” but fail to inform the consumer that their case will be referred to another firm.

Rosenbaum also argued in the complaint that Morgan & Morgan is bad for the Philadelphia legal market. “The purpose of defendants' significant advertising budget is to undermine the competition by overwhelming the consumers in the Philadelphia market with false and misleading information,” the complaint said.
