Aside from the fact that medical professionals mostly win medical malpractice lawsuits, there are also a lot of requirements needed before you can bring your claim to the court.

Prove the doctor's negligence.
It is very difficult to prove a doctor's negligence in a medical malpractice lawsuit. But if you can show to the court that the doctor is really at fault, it's more probable that you're going to win your case. Here's how to prove a doctor's negligence in a medical malpractice lawsuit:
- Show proof of a doctor-patient relationship with the doctor. If a doctor-patient relationship was set, you could tell the court that the doctor was obligated to give you reasonable care but was unable to do so.

Your doctor will be compared to a similar professional to figure out the alleged negligence or malpractice and to show the doctor's liability for the mistake he/she made.
- Show proof of the injury that resulted from the doctor's negligence or malpractice. Aside from showing proof of a doctor's negligence or malpractice, you have to show proof of the injury that resulted from his/her negligence or malpractice. You have to show to the court the injuries that the doctor inflicted on you when he/she operated on you or how your condition worsened because of his/her negligence or mistake.
- Show proof of the damages incurred. Lastly, you must show to the court the details of the damages incurred by the doctor's negligence or malpractice. These losses can include the medical expenses and the amount of wages you lost or you will lose due to not being able to work.
Convince the jury of the doctor's negligence or malpractice.
Juries often favor the doctor's side when it comes to medical malpractice lawsuits. Most juries know that medicine is an extremely complicated subject matter and its outcome doesn't always turn out to be good. So it is extremely tough to convince them to take on your side and decide that the doctor was truly negligent.

All medical malpractice lawsuits require medical experts to show proof of a negligent doctor's liability. Although there are a lot of medical experts that can help you with your case, not all of them are willing to testify against their fellow professional. You need to find a medical expert that's willing to become your key witness to show your doctor's negligence and his/her liability.
