Click, clack, wrap—the online contract is signed and sealed. The pandemic has led to an increasing number of companies moving online, and creating clickthrough and clickwrap agreements. However, in 2020, companies were less successful in defending the enforceability of those agreements in court, according to PactSafe’s 2021 Clickwrap Litigation Trends report.

According to the report, 60% of companies were successful in court in having their clickthrough agreements enforced. That is down 10 percentage points from 2019, when 70% of companies were successful in court.
