America’s pastime is no longer baseball. No, now it’s litigation — seemingly endless, seldom productive, usually exasperating. A hard truth, no?

But for corporate counsel there is a yin to this yang, namely early and effective management of employment litigation. Rub it on and, presto, gone are endless litigation update conferences, mind-numbing and eye-glazing depositions of every peripheral witness, and sweated settlements on the courthouse steps. Nuking America’s new pastime will take new ideas, both legally and cognitively.
