A trial centering on one of the most iconic political images in recent History—the so-called Obama HOPE poster—was set to begin on March 21. Sadly for copyright law aficionados, the case, which initially pitted artist Shepard Fairey (below) against The Associated Press in a high-minded debate about the relationship between art, news photography, and fair use, wasn’t what it once was. Fairey and the AP settled in January and are going into business together. What’s left was the AP’s case against a clothing maker with the exclusive license to Fairey’s work. How did we get here?
