To longtime observers of China’s intellectual property regime, the ongoing trademark dispute between Apple Inc., and Proview International Holdings Ltd., the Shenzhen-based company that claims it owns the iPad trademark in China, spotlights just how much things have changedand not for the better.
Foreign companies have long faced difficulty enforcing their IP rights in China, but in recent years multinationals have also increasingly found themselves on the other side of enforcement actions brought by Chinese companies claiming patent or trademark infringement. “[Chinese companies have] realized that they can give foreign companies a bloody nose too,” says Elliot Papageorgiou, a partner in the Shanghai office of U.K. IP firm Rouse.
