China

Clara Ingen-Housz and Fay Zhou say resale price maintenance (RPM) will continue to be a “particularly active and publicized enforcement area in China.” The People’s Republic’s National Development and Reform Commission is “leaning towards or even essentially treating RPM as ‘per se illegal’ in its enforcement,” according to Ingen-Housz and Zhou, who note China will also be focusing on cartel enforcement and other high profile areas. These include investigations into collective dominance and excessive pricing practices.
