The age of digital communication and storage is changing just about everything, including the sacred doctrine of attorney-client privilege (ACP).

To help law departments and firms protect ACP, LexisNexis Corporate Counsel Advisory put together a checklist comprising best-practice tips from its webinar featuring several attorneys who weighed in on the subject.

Some general best practices include:

  • Conducting a risk assessment of all devices and determining the sufficiency of current safeguards.
  • Implementing teamwide password and encryption policies and procedures.
  • Educating teams and clients on the basics of ACP.
  • Creating a confidentiality policy and circulating it annually.


The webinar also recommended some specific best practices for individual counsel, including:

  • Encrypting all emails, documents and data on devices.
  • Using password protection on documents and devices.
  • Eliminating an employee’s access when he or she is terminated.
