As Congress continues to debate the intricacies of proposed patent reform legislation that is designed to stop patent trolls from decimating the U.S. patent system, the U.S. Patent and Trademark Office is taking steps of its own to make life harder for patent trolls.
Acting PTO Director Michelle Lee has formally proposed a new set of rules that would require clear identification of patent owners. The rules stem from President Barack Obama’s announcement in June that he would take executive action to improve patent quality, encourage innovation and end frivolous litigation. This particular set of newly proposed rules regarding the identification of a patent’s owner are intended to create more transparency about patent ownership, which should help thwart efforts by some patent owners to hide their identity as they assert their patents.
