“Insurance denied” could possible be the two most terrifying words in the English language. Well, at least to in-house counsel. On Burns & Levinson’s The In-House Advisor Blog, Shep Davidson explains how that nightmare became a reality for one company, and how corporate counsel can avoid the same mistake.
The Saint Consulting Group had a series of different types of business insurance and in 2010, the company was sued. It sent notice of the suit through its agent, the Eastern Insurance Group, and Eastern then sent the documents on for one of the policies, but not the other. When The Hartford, the insurer on which Saint wanted to rely, finally got notice, seven months later, it denied coverage based on the delay, explains Davidson.
