Under the Occupational Safety and Health Act, employees have the right to file a complaint about a situation they feel is unsafe, explains Michael Haberman on the Omega HR Solutions Inc. website. The law also protects an employee who makes a claim from employer retaliation, he says.
OSHA mandates that the employee file a retaliation complaint “within 30 days of the alleged reprisal.” Haberman says the problem is that many workers miss the deadline. On the other hand, he says the National Labor Relations Board has a 180-day limitation.
