The polite term is lateral recruiting. More pejorative appellations include lift-outs, raiding, poaching and predatory hiring. Companies recruiting groups of employees from a competitor see an opportunity to jump-start their businesses and upgrade their talent pools. Companies that lose key employees to a competitor often experience significant business reversals and, not infrequently, consider taking legal action in an attempt to stem the bloodletting and recover compensation for losses suffered.

There are tricky issues on both sides, and no advice can cover all contingencies. But there are common mistakes to avoid when your company is doing the “raiding,” and some general principles to follow when your company is the subject of a “raid.”
