In April the U.S. Securities and Exchange Commission became the latest government agency to take action over an employer’s confidentiality agreement with employees, leaving companies to wonder how far they must go in revising their policies.

The National Labor Relations Board and the U.S. Equal Employment Opportunity Commission already had policy guidance on issues related to confidentiality, according to a blog post by employment attorney Lorene Schaefer. The NLRB’s policy prohibits a blanket approach to confidentiality during workplace investigations, while the EEOC’s dealt with overbroad confidentiality requirements related to harassment complaints.
