It’s bad news for members of made-up religions and good news for California employers. The Court of Appeal of the State of California Fourth Appellate District has ruled that employers are not required to accommodate everyone who claims to be motivated by religion, according to Jeffrey Polsky of Fox Rothschild, who writes the California Employment Law blog.
In the case at hand, a corrections officer sued the California Department of Corrections for not accommodating the religion he created: “Sun Worshipping Atheism.” Never heard of it? You’re not alone. The employee invented it. His religion required the officer to get eight hours of sleep, eat and drink when necessary and get plenty of fresh air. He refused to work overtime, even though he was informed it was part of the job when he applied. He claimed the work would interfere with the practice of his religion.
