The U.S. Occupational Safety and Health Administration has released an update to its “Whistleblower Investigations Manual.” Meagan Newman of Seyfarth Shaw says two notable changes include procedures for investigating workers who report defects in vehicles, and revisions to the chapter outlining whistleblower settlement agreements and remedies.

In that vein, one of the biggest modifications is the addition of more detail surrounding punitive damages, says Newman, “including a recognition of an employer’s good faith defense to such damages.” More guidance is provided on damages for emotional distress and, for the first time, the manual suggests employers consider providing training to employees or managers on whistleblowing rights.
