In today’s digital marketplace, a company’s employees often are the ambassadors who help sell the goods and services of the company. They are the public face of their employers, and their comments about the companies often can shape the views of customers and future employees. While a company may have control over official interactions with customers on its website and through its advertising, it may not have control over the postings made by employees on their own social media accounts, consumer websites that review the company’s performance and other websites that solicit the anonymous comments of current or former employees.
Employees had views about their employers before the Internet existed, but their ability to impact companies was limited. Now current and former employees can post negative comments concerning their employers and, given the speed with which information spreads online, these comments can be extremely harmful to their employers. Employers need to understand the nature of the threat posed by employees’ negative postings, the legal issues related to how to deal with negative comments, practical steps that can be taken to prevent such comments and how to address any that occur.
