The U.S. Equal Employment Opportunity Commission scored a win in the U.S. Supreme Court on Monday against Abercrombie & Fitch Stores Inc. The court ruled 8-1 to keep an employment discrimination suit alive in which petitioner Samantha Elauf alleged the clothing retailer discriminated against her when she applied for a job due to a headscarf she wears as a Muslim.
The victory for the EEOC, which filed suit on Elauf’s behalf under Title VII of the Civil Rights Act of 1964, sends a clear message to companies: Make hiring decisions that involve protected characteristics such as religion at your own risk.
