For companies wanting to be good corporate citizens, encouraging diversity at every level is becoming increasingly important. Recently, there has been an especially strong spotlight on gender diversity, particularly in such industries as technology, where the case of former Kleiner Perkins employee Ellen Pao has turned attention toward how women are represented and treated in the workplace.

While diversifying the workforce to include more women is a laudable goal, companies have to be aware of the limitations U.S. law places on their ability to consider gender in hiring decisions. Companies have to be especially careful when drawing comparisons to U.S. overseas neighbors, as European nations tend to have more legal latitude to act in this area.
