It looks like there’s a new pacesetter for company standards on maternity and paternity leave. Netflix Inc. announced on Tuesday that it is offering unlimited paid maternity and paternity leave for new parents for the first year after a child is born or adopted.

The new and likely unprecedented policy presents real advantages for moms and dads, who won’t have to worry about getting paid while they attend to the important task of caring for a child. However, this type of open philosophy on leave comes with potential downsides. In-house counsel should keep certain caveats in mind as they go about considering whether Netflix’s policy—or any major expansion of a parental leave policy—is right for them.
