The National Highway Traffic Safety Administration (NHTSA) this week proposed that plaintiffs lawyers be allowed to share safety defect information—such as the fatal flaw in General Motors Co.’s ignition switches—with the agency when settling civil suits against automakers.

Previously such defects were usually sealed away in confidentiality agreements as a defendant’s condition on any settlement with an injured plaintiff. That’s what happened with the GM ignition switch defect in lawsuit after lawsuit for nine years.
