Hobby Lobby is making headlines for its conservative and religious-based employment policies once again, according to Dori Stibolt of Fox Rothschild. This time the company is acting as the potty police, not allowing a transgender employee in Illinois to use the female restroom until she underwent surgery, even though she presented the company with legal documents indicating her change of sex and a letter from her health care provider outlining her treatment, Stibolt explains.

The Illinois Human Rights Commission held the company was discriminating. “Access to restrooms, if available, is a major and basic condition of employment,” according to the commission. It rejected the company’s concerns that other employees would be uncomfortable with the plaintiff’s presence in the facilities. Indeed, “the prejudices of co-workers or customers are part of what the Act was meant to prevent,” said the commission, referring to the Illinois Human Rights Act.
