If you haven’t yet made your workplace inclusive to transgender employees, you better get with the times. So far, 19 states and the District of Columbia have laws prohibiting employment discrimination based on gender identity and sexual orientation specifically, according to Taylor Whitten of Foley & Lardner. “The trend toward protecting workers and others based on their gender identity is gaining momentum, and employers should be paying close attention,” she writes. Here are some of Whitten’s tips for shaping up your workplace:

Medical leave: Never ask an employee who is transitioning for a medical record to prove it, warns Whitten. And remember, Family and Medical Leave Act covers employees who are transitioning or to help a family member with a transition.
