Many employers put new hires through a probationary period. Is that a good idea? One practitioner says it’s time to reconsider.

In a recent blog post, Jason Shinn of Shinn Legal argues that probation periods create two false assumptions: 1) the employee just has to make it through the allotted time period to maintain employment; and 2) on completion, the employment is more permanent. That’s wrong, of course, because in most states employment is “at will,” meaning all workers, whether they’ve been there 10 weeks or 10 years, can get canned (or quit) at any time for almost any reason.
