The U.S. Department of Labor is changing how it defines white-collar employees for purposes of overtime and minimum wage laws. There’s long been a DOL requirement that to be exempt from the overtime and minimum wage requirements of the Fair Labor Standards Act, a white-collar employee must have a minimum salary of $23,660 ($455 per week). But under new proposed rule-making, the threshold could be raised to $50,440 ($970 a week) and automatically re-evaluated yearly.
The DOL has submitted the rule-making to the White House Office of Management and Budget for final review. The new rules are expected to be finalized this summer.
