According to Rebentisch, any promotion or sweepstake asking for this sort of “user-generated content” requires a specific set of rules that cover appropriate content, distribution rights and indemnity from third-party copyright or trademark claims. Here are some of his tips for running a smooth social media contest.

To own or license? “We encourage our clients to license UGC rather than acquire ownership/copyright interests at the time of submission,” Rebentisch writes. He notes this can help in an intellectual property dispute over the content.
