The U.S. Equal Employment Opportunity Commission submitted an amicus brief supporting the National Labor Relations Board Wednesday, as the board tries to defend its updated joint-employer standard before the D.C. Circuit Court of Appeals.

The commission’s brief in Browning-Ferris Industries Inc. v. NLRB argues that the broader revised joint employer standard should be upheld because it is consistent with the EEOC’s own joint-employer test, which federal courts have approved in the past.
