Anthem Inc. and Cigna Corp. should reveal communications between in-house attorneys related to the proposed merger of the two insurance giants, according to a special master’s recommendation filed on Thursday.

The U.S. Department of Justice sued on July 21 to block Anthem’s proposed $54 billion acquisition of Cigna, alleging that the transaction would harm competition and result in increased health care costs in violation of the Clayton Antitrust Act. The DOJ originally combined this suit with efforts to block Aetna Inc.’s proposed merger with Humana Inc., but the two suits have since been separated.
