The office of the general counsel of the National Labor Relations Board issued an advice memo last month calling parts of Northwestern University’s handbook for its football players illegal, though those portions have since been changed.

David Rosenfeld, a shareholder at Weinberg, Roger & Rosenfeld who represents unions, brought unfair labor practice charges against Northwestern using an NLRB policy that allows outsiders to file. He alleged that handbook provisions, including those that limited the players’ ability to speak to the press without university approval and restricted their social-media use, violated Section 7 of the National Labor Relations Act. Although not legally binding, the unusual memo released on Sept. 22 in response to the charges, became public on Oct. 7 pursuant to a Freedom of Information Act request filed by sports broadcaster ESPN.
