The U.S. Department of Homeland Security adopted new regulations, effective Jan. 17, interpreting and fully implementing the immigration provisions of the American Competitiveness in the Twenty-first Century Act of 2000 and the American Competitiveness and Workforce Improvement Act of 1998. This long-awaited regulation largely codifies existing citizenship and immigration services interpretations of the statutory provisions but also implements new restrictions on certain benefits and clarified availability of others.

While the new regulation addresses certain issues and benefits for various temporary worker classifications, it most heavily impacts H-1B workers.
