Asbestos plaintiffs who received court dates prior to the Florida state asbestos and silica act’s effective date will still be subjected to its more rigorous requirements when they try to get their cases heard, the 3rd District Court of Appeal has ruled.

The court’s 2-1 decision, released Wednesday, overturns an August 2005 order by Chief Miami-Dade Judge Joseph P. Farina in his consolidated asbestos cases. It affects some 460 plaintiffs who have cases pending in that circuit court.
