The Nassau County Sheriff’s Department’s denial of line-of-duty disability benefits to a deputy undersheriff who suffered a heart attack after responding to the suicide of a fellow employee has been overturned by a New York state judge.

In Kondrup v. Reilly, 06940/06, Supreme Court Justice Thomas P. Phelan of Nassau County ruled that the department acted in an “irrational” manner when it denied Deputy Undersheriff David A. Kondrup’s application for the benefits and ordered it to take another look.
