A federal judge in Connecticut has declined to dismiss a suit against Metro-North Commuter Railroad Co. and associated defendants on behalf of a man who was electrocuted while trespassing on railroad property.

The defendants also bear responsibility for court costs and attorney fees incurred by the plaintiffs in conducting an additional deposition, the court ruled.

On April 10, Judge Jeffrey Alker Meyer in New Haven denied leave for an interlocutory appeal of his March 13 summary judgment ruling, which allowed the suit, filed on behalf of intellectually disabled plaintiff Milton Omar Colon, to move forward.
