A New Haven man injured after a North Haven police officer struck his motor scooter while in high pursuit of another vehicle has filed a lawsuit against the officer and the town.
In a 24-page lawsuit filed in New Haven Superior Court June 19 but moved to U.S. District Court in New Haven Tuesday, Jose Santini claims that Officer James Brennan was negligent and engaged in an illegal pursuit on June 21, 2015.
The lawsuit states Brennan failed to follow North Haven police pursuit guidelines in that he “initiated, engaged in and furthered a motor vehicle pursuit in violation of” police guidelines; “failed to terminate an illegal, improper and/or unlawful high speed, high risk motor vehicle pursuit”; and “engaged in a pursuit that was unreasonably dangerous to pedestrians and users of the roadway along the route of pursuit.”
