Attorneys for a 53-year-old Derby man who re-injured his lower back following a July 2016 rear-end car crash has settled for $100,000.

Attorney Josh Susco said Bruce Taylor was forced to have cervical spine fusion surgery after the Mercury Villager he was driving in Newtown was struck by a Toyota Camry driven by Christopher Colotti. The impact of the collision pushed Taylor's Mercury into a third vehicle.

Susco, an associate with Carter Mario Injury Lawyers in Waterbury, said Colotti told police he was looking down at his phone for navigational assistance when the accident occurred. Colotti, a 20-year-old Newburgh, New York, resident, was cited by police for following too closely.

Susco said since he settled with Nationwide Oct. 4., Nationwide paid Colotti's maximum policy.

“Bruce is relieved with the settlement,” Susco said Thursday. “He is not very well-off financially.” Susco added: “I think it's unfortunate the defendant did not have assets for us to go after. We were limited to the policy.”

Susco said Taylor had a pre-existing injury to his lower back which was exacerbated following the accident. “He still has lingering back pain today,” his attorney said.

Susco said an MRI revealed a large herniated disc. Dr. Kenneth Lipow, who performed the fusion surgery at Bridgeport Hospital after the accident, assigned a 25 percent physical impairment to Taylor's cervical spine.

Taylor incurred about $58,000 in medical expenses, Susco said.

Nationwide's adjuster was Pennsylvania-based Maureen Plemenos, who declined comment Thursday.
