Attorneys for a 51-year-old Fairfield man injured after he was struck and thrown over the hood of a car while riding his scooter have settled the case for $250,000.

Curtis Clarke was thrown into the windshield of Helen Warner's 2007 Honda sedan after the two collided in the driveway of Carolton Chronic Convalescent Hospital, a nursing and rehabilitation facility in Fairfield. A lawsuit was filed in Stamford Superior Court in August 2015.

According to the lawsuit, Clarke headed northbound toward the facility's driveway when he was struck by Warner's vehicle, which was moving southbound. Warner caused the crash when she turned left into the driveway directly across Clarke's lane, said Clarke's attorney, Donald Papcsy of Papcsy Janosov Roche in Norwalk. Warner, of Fairfield, was cited for failure to grant the right-of-way.

The case was settled after six hours of mediation in early January, Papcsy said. The settlement—paid via Nationwide Insurance—was received this week.

Bridgeport Superior Court Judge Dan Shaban was the mediator and played a large role in the two sides coming to an agreement, Papcsy said. Jury selection had been scheduled for Jan. 31.

In addition to his shoulder, neck and back injuries, Clarke suffered a partial tear to his rotator cuff, Papcsy said. Clarke also has post-concussion symptoms, including headaches, lack of concentration and trouble sleeping.

Clarke did not have surgery after the accident, but did accrue $24,000 in medical bills, Papcsy said.

Nationwide was represented by Terrence Molinari of the Law Offices of John P. Calabrese in Rocky Hill. Molinari did not respond to a request for comment Tuesday.
