Shelton Lawyer Overcomes Client's Prior Injury to Clinch $150K Settlement After Crash
A Stamford woman injured when her vehicle was rear-ended in Stamford in 2016 has received a settlement of $150,000. The attorney for a 38-year-old woman who injured her back and neck in a two-car crash in Stamford in 2016 has secured a $150,000 settlement.
Defendant Douglas Davis' Lexus rear-ended a 2005 Chrysler that plaintiff Analethia Williams was driving on High Ridge Road in Stamford, according to a January 2018 lawsuit filed in Stamford Superior Court.
The biggest challenge plaintiff attorney Brooke Goff said she faced was that Williams had been in a prior car crash.
"She had injuries to her back and neck, and the defense used that and said, if anything, the injuries were an exacerbation from her prior injuries," said Goff, owner of the Shelton-based Goff Law Group. "The defense produced no experts, and our client testified well in her deposition."
If the case had gone to trial, Goff told the Connecticut Law Tribune Thursday, she would have had testimony from Williams' three treating physicians, all of whom attributed new injuries to the most recent collision.
In addition to the back and neck injuries, Williams also suffered a concussion and injuries to her spine, head and chest. She also experienced headaches following the accident, according to the lawsuit.
The case was settled in a three-hour mediation before mediator and attorney Rick Mahoney in Wethersfield. Goff said her initial demand was for $300,000, while the defense's initial offer was for $30,000.
Representing Davis was attorney John Dolan of Branford-based Milano & Wanat. Dolan declined to comment on the case Thursday. The police did not issue Davis an infraction, Goff said.
Goff, who said the settlement money would be disbursed within the week, noted that Williams has had numerous steroid injections to her back and neck. "She is still limited to what she can do and has pain on a daily basis. She has trouble sleeping and can't sit or stand too long," Goff said.
Goff continued: "My client plans to utilize the settlement funds to explore different types of treatment options."
Williams, who is a Connecticut nurse, had to take time off from work, but has since returned full time, her attorney said.
